Welcome to SmartTask, a productivity app offered by SmartLink Basics, LLC (“SmartLink Basics,” “we,” “us,” or “our”). These Terms of Use (“Terms”) govern your access to and use of the SmartTask mobile application (the “App”) and any related services (collectively, the “Services”). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the Services.

1. Acceptance of Terms

By accessing or using the Services, you represent that you are at least 18 years old (or the age of legal majority in your jurisdiction) and have the right, authority, and capacity to enter into these Terms. If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Services

SmartTask helps you manage and organize tasks, track time, export data, and synchronize across devices. The Services include both free features and premium features, which are unlocked through an auto-renewable subscription (“Premium Subscription”).

3. Subscription, Payment & Billing

1. Premium Subscription

   • Term: Your subscription renews on an annual basis unless canceled at least 24 hours before the end of the current term.

   • Price: The current annual fee is displayed in the App and on your App Store or Google Play account.

2. Billing: All payments and renewals are handled by Apple’s App Store or Google Play. You authorize us to charge the payment method associated with your store account. Any changes to pricing will be communicated in-app at least 30 days before taking effect.

3. Cancellations & Refunds: You may cancel renewals at any time via your device’s store subscription settings. Cancellations take effect at the end of the current subscription term. We do not provide refunds or credits for unused portions of a subscription.

4. Restore Purchases

If you reinstall the App or switch devices, you may restore your Premium Subscription by tapping Restore Purchases in the App. No additional payment will be required so long as you use the same store account.

5. User Conduct

When using the App, you agree not to:

• Violate any law or third-party right.

• Reverse engineer, decompile, or tamper with the App.

• Transmit harmful or malicious code.

• Use the Services to harass, defame, or unlawfully discriminate.

6. Intellectual Property

The App and all content, features, and functionality (including code, graphics, and logos) are the exclusive property of SmartLink Basics or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not use our trademarks without our prior written permission.

7. Privacy

Your use of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

8. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND. SMARTLINK BASICS DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

9. Limitation of Liability

IN NO EVENT WILL SMARTLINK BASICS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING UNDER THESE TERMS WILL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE APP IN THE SIX (6) MONTHS PRECEDING THE CLAIM.

10. Changes to Terms

We may modify these Terms at any time. If we make material changes, we will notify you in the App or by email to the address associated with your account. Your continued use of the Services after the changes become effective constitutes acceptance of the new Terms.

11. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict-of-law provisions. Any dispute arising under these Terms will be resolved exclusively in the state or federal courts located in San Francisco County, California.

12. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
